Chapter 5: The Witness Who Disappeared
Daniel did not let Peter open the second envelope in the corridor.
Instead, he led them into a small conference room reserved for attorneys and their clients. He asked the clerk to record the time of their meeting and requested that no one enter without permission.
Peter placed the brown envelope on the table.
Marcus sat opposite him.
“Before we look at anything,” Daniel said, “I need to understand how you obtained these records. Are they originals, copies, or documents taken from company files?””
“The ledger is an original company record,” Peter answered.
“The documents in the smaller envelope are copies. I retained them when I resigned because I was afraid the originals would disappear.””
“Did you take them lawfully?””
Peter hesitated.
“I made copies of records I was responsible for reviewing. I didn't remove money, alter entries, or change any documents.””
“That's not quite an answer.””
Peter lowered his eyes.
“I know. My lawyer advised me not to discuss the details until I could explain the circumstances properly.””
Daniel nodded.
“Then we won't examine anything confidential beyond what is necessary until we establish the proper procedure. But I need you to explain why you're here.””
Peter looked at Marcus.
“Because Vanessa told me you already knew about the account.””
Marcus shook his head.
“I didn't.””
“She said you'd approved everything. She said you wanted the transactions kept quiet because the business was going through a difficult period.””
“That never happened.””
“I know that now.””
Marcus leaned forward.
“When did you find out?””
Peter opened the ledger.
“Fourteen months ago, I was reviewing the company's quarterly statements. I found transfers from an account that should have been inactive. The amounts weren't enormous individually, but they repeated every few weeks.””
“How much?””
“Initially, a few thousand dollars at a time. By the time I resigned, the questionable transfers totaled several hundred thousand dollars.””
Marcus felt the room tilt.
“Several hundred thousand?””
“That's what the preliminary reconciliation suggested. I haven't independently verified the final total.””
Daniel raised a hand.
“Let's be precise. You identified transactions you couldn't reconcile. That doesn't yet establish theft.””
“Correct,” Peter said.
“But I asked for supporting documents. Vanessa gave me signed authorization forms bearing Marcus's name.””
Marcus stared at him.
“And you believed her?””
Peter flinched.
“I wanted to. She was your wife. She told me you were restructuring assets before the divorce, and she showed me documents that looked legitimate.””
“You knew me for twelve years.””
“I know.””
“You could have called me.””
“I should have.””
Peter's voice cracked on the final word.
He rubbed his forehead and continued.
“When I asked to speak to you directly, Vanessa told me you were dealing with a personal crisis and had instructed her to handle the matter. A few days later, I received a letter accusing me of violating confidentiality by questioning transactions approved by the owner.””
Marcus shook his head slowly.
“She threatened you?””
“She threatened to report me to the licensing board if I disclosed information without authorization. Then she told me you had personally requested my resignation.””
“I never did that.””
“I know that now.””
Daniel folded his hands.
“Why didn't you contact Marcus after leaving the company?””
Peter looked at the ledger.
“Because I was afraid. I had a family, a mortgage, and a professional reputation. Vanessa told me that if I accused her without proof, she'd make sure I lost all three.””
Marcus stared at him.
“And now?””
“Now I've received a subpoena request from the authorities regarding the account. Someone has started looking into the transactions independently. I realized that if I stayed silent any longer, I'd become part of the problem.””
Daniel's expression grew more serious.
“Has anyone from law enforcement contacted you?””
“An investigator requested preliminary information last week. I haven't given a formal statement yet.””
“Good. You should speak to your own attorney before doing so. We won't ask you to disclose anything you're not legally permitted to share.””
Peter nodded.
Then he pushed the smaller envelope across the table.
“There's something else. This is why I came today.””
Daniel did not touch it immediately.
“What is it?””
“A copy of the authorization Vanessa gave me. And the supporting documents she used to explain the account.””
Marcus stared at the envelope bearing his name.
“Why did she write that on the front?””
“I found it in a file she left in the accounting office after she resigned from her administrative role. I don't know whether she meant to send it to you or destroy it.””
“Vanessa hasn't worked for the company in years.””
Peter looked up.
“Officially, yes. But she still had access to some old financial records through the shared document system. I discovered several logins under her old credentials after I began reviewing the transactions.””
Daniel's eyes sharpened.
“Did you preserve the access logs?””
“Yes. My lawyer has copies.””
“Then those should be obtained through the appropriate process.””
Marcus opened his mouth to ask another question, but Peter raised a hand.
“There's one thing I need you to understand. The account wasn't opened in your name alone.””
Daniel became still.
“What do you mean?””
Peter opened the ledger to a page marked with a red tab.
“The application listed Marcus Reed as the primary account holder. But the beneficial ownership section named another person.””
“Who?”” Marcus asked.
Peter looked at him.
“Vanessa.””
Marcus leaned back.
“That doesn't make sense. Why would she open an account under my information and put herself down as the beneficiary?””
“I don't know. But the bank's records should answer that.””
Daniel examined the ledger without removing it from the table.
“Did you ever see the original account application?””
“Yes.””
“Was Marcus's signature genuine?””
Peter hesitated.
“I can't authenticate handwriting. But I saw the original document, and I remember something unusual. The signature appeared to have been copied from an older authorization form.””
Marcus felt his stomach tighten.
“Which form?””
“The one you signed when your father died.””
Marcus remembered the stack of documents on the dining table, the funeral arrangements, the sleepless nights, and Vanessa bringing him papers with colored tabs.
He had signed where she pointed.
He had trusted her because she was his wife.
Daniel looked at Peter.
“Do you have the document that supports that statement?””
“Not with me. My lawyer has the copies, and the bank should have the original.””
“Then we need to proceed carefully.””
Peter closed the ledger.
“I didn't come here just to tell you about the money. There's a reason Vanessa is so desperate to win custody.””
Marcus's jaw tightened.
“Because she hates me?””
“No.”” Peter shook his head.
“Because your father left something behind.””
The room went silent.
Marcus stared at him.
“My father died seven years ago.””
“I know. But shortly before he died, he changed the ownership structure of the two rental properties. The changes were supposed to protect the properties from creditors and preserve them for the next generation.””
Marcus remembered the properties. One was a brick duplex in Ohio where his father had lived for twenty years. The other was a small commercial building that rented space to a pharmacy and two local businesses.
“What does that have to do with Ava?””
Peter looked uncomfortable.
“Your father created a trust. The documents I reviewed suggested that Ava was named as a future beneficiary.””
Marcus felt his chest tighten.
“A trust? Nobody told me that.””
“Vanessa knew about it.””
Daniel leaned forward.
“Are you certain?””
“I saw correspondence about it. I don't know the current terms, and I haven't reviewed the complete trust instrument. But the correspondence suggested that control of the assets would change when Ava reached a specified age or if certain conditions were met.””
Marcus thought about the note Ava had found.
Once custody is secured, complete the transfer before the audit.
A cold realization began to form.
“Was the account connected to the trust?””
Peter nodded slowly.
“That's what I believe the audit was supposed to establish.””
“Why would Vanessa need custody to transfer money from a trust?””
“I don't know whether she could. That's why the legal documents matter.””
Daniel stood and walked to the window.
“If this involves a trust created for Ava, the court will need to know whether anyone has attempted to misuse the child's interests. But we cannot assume that the custody dispute was designed for that purpose without evidence.””
Peter agreed.
“There's another document that may help.””
He removed a single sheet from the ledger and placed it face down on the table.
“It's a letter from the attorney who handled your father's estate. I found it attached to the account records. It says that any attempt to alter the beneficiary arrangements without the required consent would trigger an independent review.””
Marcus reached for the page.
Daniel stopped him.
“Let's have it copied and preserved properly.””
Peter nodded and turned the paper over.
The letter was dated six years earlier.
At the bottom, beneath the attorney's signature, was a handwritten notation.
*Original beneficiary designation held in sealed custody. Do not release without verification of Marcus Reed's identity.*
Marcus frowned.
“What does that mean?””
Peter looked at him.
“I think it means your father anticipated that someone might try to change the arrangement after he died.””
Daniel's phone rang.
He glanced at the screen, answered, and listened for several seconds.
Then his face tightened.
“Understood. Please send that to me through the secure channel.””
He ended the call and looked at Marcus.
“That was our investigator. The bank has acknowledged the formal dispute request.””
“And?””
“They've identified a second authorization linked to the account. It was submitted three weeks before your divorce filing.””
Marcus swallowed.
“Who authorized it?””
Daniel glanced toward the conference room door.
“The bank hasn't confirmed the person yet. But the authorization was used to request a transfer of the properties your father placed into the trust.””
Peter closed his eyes.
“That means the transfer may already have been initiated.””
Before anyone could speak, someone knocked hard on the conference room door.
The clerk opened it a few inches.
“Mr. Brooks, I'm sorry to interrupt. Mrs. Reed's attorney has requested an emergency conference with Judge Williams.””
Daniel stood.
“On what grounds?””
The clerk looked at Marcus.
“Mrs. Reed alleges that Mr. Reed threatened her during the recess and attempted to obtain confidential financial records through intimidation.””
Marcus shot to his feet.
“What? I haven't even spoken to her!””
The clerk looked deeply uncomfortable.
“Her attorney says he has a witness.””
Daniel's face hardened.
“Who?””
The clerk hesitated.

Then he delivered the answer that made Peter Lawson go white.
“Mr. Lawson.””
