Chapter 8: The Trap Behind the Trust
By noon, Michael was standing in the conference room of his construction company's headquarters, staring at a projected bank ledger.
Robert Hayes had assembled the company's controller, outside auditor, and legal counsel. Every person in the room had been instructed to preserve the records and avoid making accusations until the evidence could be verified.
On the screen, one transaction glowed beneath the others.
*$75,000 — EDUCATION TRUST ADMINISTRATION.*
The recipient was a consulting firm that had received payments from Michael's company years earlier.
The transfer was scheduled to clear at 2:00 p.m.
Michael pointed at the screen.
“Who authorized this?””
Robert clicked to the next page.
“The payment was entered using delegated access associated with your household financial administration. The supporting document contains your electronic signature.””
Michael shook his head.
“I never approved it.””
“I believe you,” Robert said.
“But the auditor needs to establish how the authorization was created.””
Their outside counsel, Laura Mitchell, opened a notebook.
“Michael, we should not cancel or alter the transaction without documenting the process. The bank can place a temporary hold while the authorization is reviewed. We'll also need to notify the trustee if the transfer relates to Lily's education funds.””
“Do it.””
Laura nodded to Robert.
“Contact the bank's fraud department. Request preservation of the authorization records and a hold pending verification.””
Robert picked up the phone.
While he spoke with the bank, Michael examined the supporting document.
It claimed the transfer was intended to reimburse expenses associated with Lily's educational planning.
But the invoice attached to it listed services that had never been provided.
College placement consulting.
Private admissions advising.
Administrative coordination.
The total was exactly $75,000.
Michael looked at Laura.
“This is fraudulent.””
“It appears inconsistent with the records we have,” she replied.
“We should let the forensic review establish who created it and who benefited.””
Michael paced to the window.
He wanted to call Vanessa and demand an explanation. He wanted to call Richard Cole and ask how many years they had been lying to him.
But anger wouldn't establish what happened.
Evidence would.
Robert ended the call.
“The bank has placed a temporary hold. They've preserved the submission records and will send us the technical information through the fraud review process.””
Michael exhaled.
“Good.””
Laura closed her notebook.
“Now we need to decide how to protect the trust and the company. I recommend separate legal reviews, because the education trust and the business accounts involve different obligations.””
Michael nodded.
“Whatever is necessary.””
His phone vibrated.
A message from Vanessa.
*We need to talk. Alone. Tonight.*
He stared at it.
Then another message appeared.
*If you involve lawyers, you'll regret what happens to Lily.*
Michael showed the messages to Laura.
Her expression hardened.
“Save those. Don't respond with anything threatening or accusatory. We'll preserve the communications and discuss whether they need to be provided to investigators.””
Michael forwarded the screenshots to the company's legal counsel and placed his phone on the table.
Vanessa had made a mistake.
She had put the threat in writing.
At 1:30 p.m., the foundation's compliance director called.
Patricia Reynolds sounded exhausted.
“Mr. Carter, we reviewed the materials your attorney sent. We have temporarily suspended further administrative changes to Lily's scholarship record.””
Michael gripped the phone.
“What does that mean for Lily?””
“It means the withdrawal will not be treated as final while the investigation is ongoing. We're reviewing the authorization and the circumstances surrounding the request.””
“Can she still attend the university?””
“Her original award is being reconsidered. I don't want to promise an outcome before the review is complete, but we recognize that the request may not have been authorized.””
Michael closed his eyes briefly.
“Thank you.””
“There is something else,” Patricia continued.
“Our internal review identified communications between Daniel Price and an external party regarding the proposed withdrawal.””
“Richard Cole?””
A pause.
“Yes. That name appears in the records.””
Michael looked at Laura.
“Can you tell me what those communications said?””
“Not in full while the review is active. But I can confirm that the foundation has referred the matter to its independent oversight committee.””
After the call, Michael went to the conference room's smaller adjoining office and called Lily.
She answered on the first ring.
“Dad?””
“The foundation has suspended the withdrawal. Your scholarship is under review, but your application hasn't been permanently closed.””
There was silence.
Then he heard a small, broken sound.
“Does that mean I might still go?””
“Yes. It's possible.””
Lily began to cry.
Michael sat down.
“I'm sorry, sweetheart.””
“Why are you apologizing?””
“Because I should have believed you the first time.””
She sniffed.
“You can't change that now.””
“No. But I can change what I do next.””
For a moment, neither spoke.
Then Lily asked, “Are you going to meet Vanessa tonight?””
Michael looked at the message on his phone.
“Yes.””
“Dad, please be careful.””
“I will. I'm not meeting her alone, and I'm not going to do anything outside the law.””
Lily was quiet.
“Can I come?””
“No. I want you with Aunt Eleanor tonight. You deserve one evening when you're not forced to defend yourself against everyone.””
“I'm tired of being treated like the problem.””
“I know.””
After the call, Michael arranged for Eleanor to collect Lily from the house. He then contacted Laura and explained Vanessa's request for a private meeting.
Laura insisted that any discussion about the disputed finances take place in a public location and that Michael avoid agreeing to anything that could compromise the investigation.
By six o'clock, Michael was sitting in a quiet restaurant near downtown Austin.
Vanessa arrived ten minutes late.
She wore a dark blue dress and carried a small leather handbag. Her makeup was immaculate, but her eyes looked swollen, as if she had spent the afternoon crying.
She sat across from him.
“You look terrible,” she said.
Michael didn't respond.
Vanessa folded her hands on the table.
“I know you're angry.””
“You threatened Lily.””
“I was upset.””
“That doesn't excuse it.””
She looked away.
“I didn't mean what I said.””
“Then why did you say it?””
Vanessa exhaled.
“Because everything is falling apart, Michael. The company is investigating me. The foundation has suspended the scholarship.
Eleanor is interfering in our marriage. And now you're treating me like a stranger.””
Michael stared at her.
“You used my signature to withdraw Lily's application.””
“I didn't forge your signature.””
“You supplied the documents that led to it.””
“I asked Daniel to help with an administrative problem.””
“You asked him to stop my daughter from attending college.””
Vanessa's eyes filled.
“I thought she was making a mistake.””
“Then you should have talked to her. You should have talked to me.””
“I did talk to you!””
“No. You told me she was dramatic and ungrateful. You made me believe she was the problem.””
Vanessa wiped her cheek.
“I was afraid.””
Michael leaned forward.
“Afraid of what?””
She looked down at the table.
“Of losing everything.””
“What does that mean?””
Vanessa's voice dropped.
“Richard told me that if the trust was examined, the old transactions would be exposed. He said the company could be investigated, the foundation could lose its funding, and the people involved could face serious consequences.””
Michael felt his chest tighten.
“You knew about the old transactions?””
Vanessa pressed her lips together.
“I knew some money had moved through consulting accounts. Richard told me it was legitimate business.””
“And you believed him?””
“I wanted to.””
“Why?””
Vanessa looked at him with a desperation he had never seen before.
“Because he said he could protect me.””
Michael stared at her.
“Protect you from what?””
She hesitated.
Then she said, “The original trust agreement gave Eleanor authority to investigate certain transactions if Lily's education funds were interfered with. Richard was afraid she'd discover what happened six years ago.””
Michael's hands tightened beneath the table.
“So you tried to withdraw Lily's scholarship to prevent the trust from being examined?””
Vanessa shook her head quickly.
“Not at first. I thought if Lily stayed home, she wouldn't ask questions about the trust. Then Daniel said the scholarship could be withdrawn administratively, and Richard told me the problem would disappear.””
“Did you pay Daniel?””
“I paid his consulting business.””
“Twelve thousand dollars?””
“Yes.””
“Why?””
“He said it covered the administrative work and the risk involved.””
Michael felt sick.
Vanessa had paid someone to help interfere with Lily's scholarship, then continued to conceal the truth even as her stepdaughter cried herself to sleep.
“Did you know about the $75,000 transfer scheduled for today?””
Vanessa's head snapped up.
“No.””
“It's supported by a document carrying my electronic signature.””
“I didn't authorize it.””
“Your account was used to submit it.””
She looked genuinely startled.
“Richard must have done it.””
Michael studied her face.
“Why would Richard use your account?””
“Because he had access to the consulting network. I don't know what he's doing now.””
“You've been working with him for years. You must know something.””
Vanessa began to cry.
“I was wrong, Michael. I know that. But I never wanted Lily to be hurt.””
Michael's voice became quiet.
“You knew she had worked for years to earn that scholarship. You knew she wanted to leave home and build her own life. And you chose to take that away from her.””
Vanessa covered her face.
“I thought I could fix it later.””
“You destroyed her letter.””
“I panicked.””
“You let me believe she was lying.””
“I panicked!””
People at nearby tables glanced toward them.
Vanessa lowered her voice.
“I thought if I could get the trust changed, everything would be settled. Richard said the company could recover the money through a restructuring arrangement. He promised me that Lily would still have opportunities later.””
Michael stared at her.
“Did you know Sarah had suspected Richard?””
Vanessa stopped crying.
For a moment, something cold passed across her face.
“Yes.””
Michael felt as if the air had vanished from the room.
“How long have you known?””
“Richard told me after we started dating.””
“And you still married me?””
Vanessa's eyes flashed.
“I loved you.””
“Did you?””
“Yes!””
“Or did you want access to my company?””
Vanessa recoiled.
“I cannot believe you'd say that.””
“Then give me a reason not to.””
She looked down at her hands.
When she spoke again, her voice was barely audible.
“Richard told me the company would eventually become vulnerable if the old transactions were examined. He said being close to you would give him time to resolve the problem.””
Michael sat perfectly still.
“You married me because Richard wanted you close to my finances?””
Vanessa began to shake her head.
“It wasn't like that at first.””
“Answer me.””
“I thought I could help him.””
Michael pushed his chair back.
He had come to the restaurant hoping Vanessa might finally tell him the truth.
Instead, she had confirmed his worst fear.
Their marriage might have begun as part of a plan he had never known existed.
He stood.
“The meeting is over.””
Vanessa grabbed his wrist.
“Michael, please. If you leave now, Richard will know I talked.””
Michael gently removed her hand.
“You should have thought about that before you threatened my daughter.””
He turned toward the exit.
Behind him, Vanessa whispered, “You don't understand. Richard has something on me.””
Michael stopped.
“What?””
Vanessa's face had gone pale.
“He has the original agreement. The one I signed.””
Michael slowly turned around.
“What agreement?””
She looked toward the restaurant windows.
“The document that proves I knew about the transfers before I married you.””
Michael felt a chill move through him.
“Where is it?””
Vanessa swallowed.
“I don't know. But Richard told me that if I ever betrayed him, he'd make sure everyone knew what I did.””
Michael's phone vibrated.
A message from an unknown number appeared.
It contained a photograph.
Vanessa was sitting across from him in the restaurant, her face turned toward the window.
The picture had been taken from outside.
Beneath it was a single sentence.
*Ask your wife what she promised Richard in exchange for marrying you.*
Michael looked toward the glass.
Across the street, a black SUV pulled away from the curb.
May you like
He barely caught a glimpse of the driver.
Richard Cole.
