Chapter 5: The Promise Her Mother Made

Daniel forwarded the photograph and both messages to Ms. Collins before calling the police non-emergency line to ask about the circumstances of the apparent surveillance.

He didn't know who had taken the picture, how old it was, or whether it had any connection to Vanessa's legal filings. He refused to turn an anonymous message into an accusation.

But he couldn't ignore the warning.

By ten that morning, Ms. Collins had contacted Vanessa's attorney and requested clarification about the recording, the photograph, and the allegedly altered text messages.

The response arrived shortly before noon.

Vanessa denied having anything to do with the photograph.

Her attorney also denied knowing the identity of the sender.

However, he confirmed that the recording had been provided by Vanessa as part of her custody case.

Daniel read that sentence three times.

He called Ms. Collins.

“She gave them the recording?””

“Yes.””

“Then she knows where it came from.””

“Not necessarily. She may have received it from someone else. We need to ask directly and preserve the evidence.””

Daniel looked through the kitchen window toward the yard.

Ariana was sitting on the porch swing with Emily, drawing small flowers in a notebook. Every few minutes, she looked toward the house as though checking that her father was still there.

He lowered his voice.

“There's something I haven't told you.””

“Go ahead.””

“Vanessa has been asking for full custody since before we separated. At the time, I thought it was because she was afraid of losing her relationship with Ariana.””

“And now?””

“Now I'm wondering whether there's something else.””

Ms. Collins was quiet for a moment.

“Do you have a reason to believe that?””

Daniel thought about the last year of his marriage.

Vanessa had been under unusual pressure at work. She spent hours on the phone after Ariana went to bed. Sometimes she would close her laptop as soon as Daniel entered the room.

When he asked what was wrong, she always gave the same answer.

“Nothing you need to worry about.””

He had accepted it because he wanted to believe they were simply going through a difficult period.

But one night, about two months before their separation, he had found Vanessa crying in the laundry room.

She had been holding a document with the name of a financial company printed across the top.

When she noticed him, she folded it quickly.

“What is that?”” he had asked.

“Work.””

“Why are you crying?””

“Because I'm tired, Daniel. Not everything has to be an interrogation.””

He had backed away.

Now the memory returned with uncomfortable clarity.

“I think she was hiding a serious problem,” he told Ms. Collins.

“I don't know what it was.””

“Don't investigate it yourself. If it's relevant to custody, we'll request appropriate records through legal channels.””

Daniel agreed.

Then he looked outside again.

Ariana had stopped drawing.

She was staring at her notebook, rubbing her thumb over the edge of the page.

He ended the call and stepped onto the porch.

“Hey, sweetheart.””

Ariana looked up.

“Hi, Daddy.””

“Would you like to help me make lunch?””

“Okay.””

Emily squeezed Daniel's shoulder before heading inside.

At the kitchen counter, Ariana washed strawberries while Daniel sliced bread.

For several minutes, they worked quietly.

Then Ariana spoke.

“Daddy, are you going to court again?””

Daniel set down the knife.

“Probably. The adults still have some things to work out.””

“Did Mommy tell the judge something bad about you?””

He considered lying.

He could tell her everything was fine, that the lawyers were simply doing their jobs, that she didn't need to worry.

But he had promised himself he would stop using comforting lies to hide difficult truths.

“Your mom has raised some concerns about how we've handled things,” he said carefully.

“The lawyers are going to look at them.””

“Did you do something wrong?””

“I don't believe I did what she's accusing me of. But if I made mistakes, I'll take responsibility for them.””

Ariana nodded slowly.

“That's what I want Mommy to do.””

Daniel felt the weight of her words.

“Sweetheart, your mother is more than the things she's said in court. She's a person who can make mistakes, just like I can.””

“But she says she didn't make any mistakes.””

“Then I hope she has time to think about it.””

Ariana placed a strawberry on the cutting board.

“Can I tell you something about the night before court?””

“Of course.””

“Mommy made me practice what to say.””

Daniel's hand stopped above the bread.

“What do you mean?””

“She sat on my bed and told me to repeat the words after her.””

Ariana's voice grew smaller.

“She said I should tell the judge that I feel lonely at your house and that you talk about her when she's not there.””

Daniel took a slow breath.

“Did you say those things?””

“I said them because she asked me to.””

“Did you feel lonely at my house?””

Ariana shook her head.

“No. Sometimes I miss Mommy, but you let me call her.””

“Did I talk badly about her?””

“No.””

Daniel pulled out a chair.

“Thank you for telling me. You don't have to explain anything else right now.””

Ariana climbed into the chair opposite him.

“Daddy, why would Mommy want me to say something that isn't true?””

He searched for an answer that wouldn't make her feel responsible for understanding her mother's behavior.

“Sometimes adults become so frightened of losing something important that they make choices they shouldn't. That doesn't make those choices right.””

“Is she frightened of losing me?””

“I think she is.””

“Then why does she keep making me scared?””

Daniel couldn't answer immediately.

He reached across the table and took her hand.

“I don't know, sweetheart. But I'm going to keep working to make sure you feel safe.””

Ariana looked down at their hands.

“Mommy told me she had a promise to keep.””

Daniel went still.

“What kind of promise?””

“She said she promised someone that I would always live with her. She said she couldn't go back on it.””

“Who did she promise?””

“I don't know. She wouldn't tell me.””

Ariana frowned, trying to remember.

“She was on the phone one night. I came downstairs because I wanted water. She didn't see me.””

“What did you hear?””

“She said, 'I gave you my word. Ariana will stay with me, no matter what Daniel does.''”

Daniel felt a chill move through him.

“When was this?””

“Before the summer. Maybe June.””

“Did she say anything else?””

Ariana nodded.

“She said something about the house and money. Then she said she couldn't lose both.””

“Lose both what?””

“I don't know, Daddy. She saw me, and she told me to go upstairs.””

Daniel gently brushed a crumb from Ariana's sleeve.

“You did the right thing by telling me. But I don't want you to feel like you need to investigate anything for me. That's an adult responsibility.””

Ariana looked frightened.

“Are you going to tell Mommy I said that?””

“I'll talk to my lawyer about what to do next. I won't put you in the middle of a confrontation.””

She seemed relieved.

After lunch, Daniel drove Ariana to her scheduled meeting with a child therapist recommended by the court.

He stayed in the waiting room while Ariana spoke privately with the therapist.

When the session ended, Ariana emerged holding a small paper bag.

“What did you make?”” Daniel asked.

“A feelings kit.””

She showed him a deck of cards with words such as sad, safe, confused, and angry printed on them.

“The therapist said I can use these when I don't know how to explain something.””

Daniel smiled gently.

“That's a good idea.””

Ariana slipped the cards into her backpack.

Then she hesitated.

“Daddy, can I ask you something?””

“Anything.””

“If the judge lets me live with you, will Mommy have to pay you money?””

“No. That's not what this is about.””

“But what if she thinks that's why you want me?””

Daniel crouched in front of her.

“I would rather have you be happy and safe than win a single dollar from your mother. I don't want you to worry about money or court orders. That's for the grown-ups to handle.””

Ariana hugged him.

“Okay.””

That evening, Daniel received a call from Ms. Collins.

“I've spoken with Vanessa's attorney,” she said.

“There's something you need to know.””

“Go ahead.””

“Vanessa has requested an emergency hearing. She claims the anonymous messages and your recent conversations with Ariana demonstrate that you're attempting to undermine her custody position.””

Daniel rubbed his forehead.

“She knows about the messages?””

“She was notified through counsel because the photograph appears to have been taken on your property. Her attorney says she believes you staged it.””

“I didn't.””

“I believe you. We'll preserve the original file and let the court assess the evidence.””

Daniel looked toward the living room, where Ariana was arranging colored pencils into a rainbow.

“What about her promise?””

“I'm requesting information about any agreements or financial arrangements that might be relevant. But I need to ask you something first.””

“What?””

“Before the separation, did Vanessa ever ask you to sign documents concerning Ariana's future care, education, or inheritance?””

Daniel thought carefully.

Then he remembered a packet Vanessa had brought home about eighteen months earlier.

She had placed it on the kitchen table and asked him to sign several pages.

“It's just financial planning,” she'd said.

“For Ariana's future.””

He had been tired after work and hadn't read every page.

He had signed where she pointed.

“I did,” he admitted.

“But I don't know exactly what was in them.””

Ms. Collins's tone changed.

“Daniel, can you find a copy?””

“I'll look tonight.””

He searched the filing cabinet in his study after Ariana went to bed.

He found tax returns, insurance policies, school records, and the original mortgage documents.

At the bottom of a drawer, beneath a stack of old bank statements, he found a blue folder with Vanessa's handwriting on the tab.

*Ariana — Future Security.*

Inside were copies of the documents he had signed.

The first pages concerned a college savings account.

The next contained a life insurance policy.

But the final document was different.

It was an agreement involving a private family trust established by Vanessa's late father, with conditions attached to the distribution of certain funds.

Daniel read the first paragraph.

Then he read it again.

The trust provided substantial financial support for Ariana's education and living expenses, but one section required the designated custodial parent to maintain primary residential custody until Ariana reached adulthood, subject to a court's determination of her best interests.

A separate provision described what would happen if the family circumstances changed.

Daniel's mouth went dry.

The document did not give Vanessa an automatic right to custody. It did, however, create a financial incentive for her to fight for it.

He photographed every page and sent the copies to Ms. Collins.

Her reply arrived within minutes.

*Do not contact Vanessa about this. I need to review the complete trust documents and determine whether the agreement is enforceable or relevant to the custody proceedings.*

Daniel closed the folder.

He now understood why Vanessa might be terrified of losing custody.

But the trust couldn't explain the recording.

It couldn't explain the photograph taken through his kitchen window.

And it couldn't explain why someone had sent him a warning about a promise Vanessa had made.

His phone vibrated again.

May you like

This time, the message came from Vanessa herself.

*We need to talk before the hearing. Just you and me. There's something about Ariana you don't know, and if you find out from the lawyers, you'll never forgive me.*
